ACPA Policy Alert: Court Ruling on Title IX Regulations
ACPA-College Student Educators International, through its Public Policy and Governmental Affairs Task Force, is providing this policy alert in regards to the current status of the 2024 Title IX regulations in the United States.
On Thursday, January 9, 2025, a federal judge in Kentucky in the case of Tennessee v. Cardona ruled that all of the Title IX regulations issued by the U.S. Department of Education on April 19, 2024, and implemented on August 1, 2024, violated the U.S. Constitution. Thus, the 2024 Title IX regulations are effectively halted nationwide.
Prior to the 2025 decision, the implementation of the new regulations had already been suspended in 26 States, as well as at specific education institutions in the United States due to a court decision in Kansas. As a result, half the United States were already following the new regulations and the other half were following outdated ones.
In light of this decision, we encourage members and higher education professionals to engage with their institutional Title IX and Equal Opportunity offices, as well as General Counsel, to learn more about how their institution is affected by this new ruling, and actions they are taking in moving forward.
